2. Services Description
SCM Santa Clara Masonry provides professional masonry services including but not limited to brick repair, chimney rebuilding, tuckpointing, retaining wall installation, patio construction, and related masonry work. All services are performed by licensed and insured professionals. Specific project details, timelines, and costs will be outlined in individual written estimates and contracts.
3. Estimates and Pricing
We provide free on-site consultations and written estimates for all projects. Estimates are valid for 30 days from the date of issue. Final pricing may vary from estimates if unforeseen conditions are discovered during work or if you request changes to the project scope. We will notify you of any price changes before proceeding with additional work. Payment terms will be specified in your project contract.
4. Project Timeline
Project timelines provided in estimates are approximate and based on normal working conditions. Actual completion times may vary due to weather, material availability, permit delays, or other factors beyond our control. We will keep you informed of any delays and work diligently to complete your project as quickly as possible without compromising quality.
5. Customer Responsibilities
You agree to provide clear access to the work area and ensure that the site is ready for work to begin as scheduled. You are responsible for obtaining any necessary permissions from homeowners associations or other governing bodies. You must inform us of any known hazards or special conditions on your property before work begins. You agree to make payments according to the schedule outlined in your contract.
6. Warranty and Guarantees
We stand behind our work with warranty coverage as specified in your project contract. Warranty terms vary depending on the type of work performed and materials used. Warranties cover defects in workmanship and materials but do not cover damage caused by acts of nature, improper maintenance, or alterations made by others. To maintain warranty coverage, you must follow any maintenance recommendations we provide.
7. Changes and Cancellations
Changes to project scope must be requested in writing and will be subject to additional charges. If you cancel a project after work has begun, you will be charged for all work completed, materials purchased, and reasonable costs incurred. Cancellation policies specific to your project will be detailed in your contract.
8. Liability and Insurance
SCM Santa Clara Masonry maintains appropriate liability insurance and workers compensation coverage. We are not responsible for damage to underground utilities that are not properly marked. We are not liable for damage to landscaping, hardscaping, or other property features unless caused by our negligence. Our total liability for any project is limited to the contract price for that project.
9. Property Damage and Claims
We take great care to protect your property during work. If damage occurs, you must notify us in writing within 7 days of project completion. We will assess the damage and make repairs or provide compensation as appropriate. Claims not reported within this timeframe may not be honored.
10. Dispute Resolution
If a dispute arises, we agree to first attempt to resolve it through direct communication and good faith negotiation. If we cannot reach a resolution, disputes will be handled through mediation or arbitration in Santa Clara County, California, before pursuing legal action. These terms are governed by the laws of the State of California.
11. Modifications to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.
